• Guess Élite (or Program) Material Terms; Categories of Personal Information. Our Program allows you to accumulate points in order to receive discounts and other offers. In order to register, you will be asked to provide your first and last name, email address, month and day of birth (optional), and gender (optional). As part of your program profile, you may also choose to provide an international prefix, phone number, country-zip-city address, and communication language. We will also collect various commercial and behavioral information that may be associated with your use of your Program account. Availability of certain incentives may depend on your Status level. • In-Store WiFi. When you use our free WiFi in our Stores, we collect personal information from you at registration, including your first and last name, email address, phone number, date of birth (voluntary), gender (voluntary), and mailing address (voluntary).
• Email and Text Sign Up. When you sign up to receive recurring promotional and personalized marketing messages, we may offer you special savings in the form of digital coupons for free or discounted products and announcements of sweepstakes, contests, and giveaways, subject to applicable laws. Reasonable Relation to Value of Data: We estimate the value of the personal information provided by Program members to be approximately $9.87 per member per year. This good-faith estimate is based on the average annual cost of operating the Program per active member (including platform, management, communications and promotional costs), which we compared against the approximate additional revenue generated by Program members relative to non-members, and we have used the higher of the two figures.

How to Opt In: You opt in to participate in the Program, and to Guess's collection, use, and disclosure of personal information as described in this Privacy Policy and the Program Terms and Conditions, when you enroll in the Program and agree to receive Program-related communications. We will obtain separate consent where required by applicable law, such as for sending any marketing text (SMS) messages. To opt out of marketing communications or exercise other privacy choices, follow the instructions in this Privacy Policy or in the applicable communication. Your choice will not affect participation in the Program except to the extent a particular Program benefit cannot reasonably be provided without the relevant processing.

Right and Method to Withdraw: Your participation in these programs is strictly voluntary, and you may withdraw your consent to participate at any time by reviewing and following the steps outlined in our Program Terms and Conditions or emailing us at [email protected]. Withdrawal may result in the loss of access to Program benefits as described in the Program Terms and as permitted by applicable law.

We will process any exercise of an applicable privacy right in accordance with applicable law and the Guess Privacy Policy. Where such exercise materially affects the ability to provide specific Program benefits, we will inform you before discontinuing the affected benefit. If we know, or have reason to know, that you are under the age of 18, we will not sell or share your personal information, or use it for targeted or cross-context behavioral advertising, and we will treat you as opted out of those activities, if and as required by applicable law.
